GALLIPOLIS — A Gallia County man who allegedly smuggled drugs into the Gallia County Jail last year was recently charged in the Gallia County Common Pleas Court.

Dustin L. Fellure, 28, Bidwell, was recently arraigned on three counts of illegal conveyance of drugs onto the grounds of a detention facility and three counts of possession after he allegedly brought two yellow tablets containing methylphenidate, one brown tablet containing morphine and 0.1 of a gram of heroin into the jail on September 7, 2012.

According to the report filed with the Gallia County Sheriff’s Office, Fellure was brought into the Gallia County Jail during the early morning hours of September 7 after being arrested by a trooper with the Ohio State Highway Patrol on a Washington County warrant.

When Fellure was changing into his prison uniform, a corrections officer reportedly observed a clear plastic bag in the suspect’s underwear.

The bag was confiscated and was found to contain three pills and an unknown substance in yellow cellophane.

The pills and unknown substance were later sent to the lab with the Ohio Bureau Criminal Identification and Investigation for analysis.

The unknown substance was identified as heroin, the brown pill was found to contain morphine and the two yellow pills contained methylphenidate — a medication widely prescribed to treat attention deficit disorder.

An indictment in this case was filed on October 19 and a warrant was issued for Fellure’s arrest.

According to the Gallia County Sheriff’s Office website, Fellure was arrested on January 7 by the sheriff’s office on the warrant on indictment.

During his hearing last week, Fellure pleaded not guilty to the charges against him and was later released on a $30,000 own recognizance bond.

A plea agreement in this case may be filed by April 12. A jury trial has been scheduled for May 7.

According to the Marietta (Washington County) Municipal Court’s online docket, Fellure was charged in October 2009 and later pleaded not guilty to a first-degree-misdemeanor charge of theft.

He was sentenced to 90 days in jail with 45 of those days suspended with a payment of restitution in the amount of $732 to the victim.

In February 2010, a probation violation was filed in this case and a warrant was issued for his arrest.

Following Fellure’s arrest in Gallia County in September, the defendant appeared in the Marietta Municipal Court and pleaded not guilty to probation violations.

A hearing in this case has been scheduled for January 16.

In a previous Gallia County case, Fellure was charged in November 2009 with one count of burglary.

The defendant later pleaded guilty to this charge and was sentenced as per a plea agreement in June 2010 to two years of probation and ordered to complete the SEPTA program.

Fellure’s probation was later terminated successfully in June 2012.
